RK Autowerks, LLC refused to repay my funds
My formal complaint is directed at RK Autowerks for not honoring the payment of $6500 for the two turbos and the engine core of a 2017 BMW M6 which was supposed to be paid before returning the car parts.
On December 12, 2022, I purchased a BMW M6 Motor, a.k.a Forged S63tu, for $32,073 from R K Autowerks and had it shipped to Four Arrows for installation. According to the contract, they were supposed to buy shipping and insurance both ways which Global Logistics was chosen for. After completion, the original engine core and two turbos were properly packaged and sent to R K Autowerks.RK Autowerks policy states that the warranty involves a return of $2500 for the turbos and a maximum of $4000 for the transmissions.
First: The expenses related to shipping and insurance fell upon RK Autowerks. Second: Four Arrows provided the turbos and core within a securely packaged container. Third: From their wish that I put in an insurance claim, RK Autowerks understood that a turbo was expected to be in the container. Fourth: The turbo is absent because as per the documents provided by rk autowerks, the container was supposed to be damaged. Fifth: It was the duty of RK Autowerks to claim damages with Echo Global Logistics immediately after the receipt of the damaged delivery. Sixth: It is RK Autowerks who needs to reimburse the amount of $6500 in due time per the agreement.
I did all I could to allow certified mail with restricted delivery to personally reach the owner, Razza Kalid. A reply was received from the sales department – Dominski at [email protected]. The reply offered came from the same party denying responsibility in the first instance.
As stated by RK Autowerks, on May 15th, 2023, a box containing the engine and turbos was shipped is claimed to have arrived in a damaged condition and is claimed to have been upside down and empty. R K Autowerks claims to have sent me an email requesting to claim to claim, but as forensic analysis of emails means I never received that email, the in my 2015 emails.
RK Autowerks asserts that it was my obligation to submit the claim, and because I did not respond to the email, it was far too late. This is false; the contract is between RK Autowerks and Echo Global Logistics, and it was their responsibility to submit the claim. Furthermore, RK Autowerks has not offered any evidence that they could not submit the claim because too much time had passed.
